Accused as a thief - not (properly) paid by mistake
Beschuldigt als Dieb - nicht (richtig) bezahlt aus Versehen
Today I bought a few things at Migros in Thalwil (most of them reduced or on promotion) for a total of 46.60 Fr. I scanned all the items as usual at the self-checkout. I was about to pay when I realized that I still had to scan a pack of Buscuits, so I made up for it. I have to add that I was there with my 1-year-old daughter, who kept throwing a ball I had just bought off the baby carriage and she was already pretty tired as it was around 7pm. I then packed all the scanned items in the baby carriage and politely said goodbye to the security guard who had been standing behind me the whole time. He suddenly asked me for the receipt and I replied that I didn't know where I had put it or that I didn't know where it was. The cash register display said something along the lines of "service coming", but at that moment I didn't realize that something had gone wrong with the payment or that I had forgotten to pay. I usually pay with a contactless card and it usually happens so quickly that I hardly notice. Unfortunately, I can't remember if I actually held the card in my hand and used it or if it was just my intention, but I didn't want to take home the items, which I scanned down to the last one and most of which were reduced anyway, without paying. I was simply stressed about my daughter and didn't realize that I had accidentally not paid. The security guard didn't want to understand and just let me make up the payment and became aggressive and called a few Migros employees. They then led me with my daughter, who cried a little in between, through the inner corridors to a small office, where they wanted to do a random check, but actually chopped off all the items. They also made me sign a report that said something about theft and a 200 CHF fine. They didn't give me a copy of it, so I don't know exactly what's on it and I'm worried at the moment whether I might have to press charges. I just wanted to get home as quickly as possible to put my daughter to bed and I didn't pay the fine on the spot - they asked me if I wanted to pay straight away or receive a bill and I opted for the latter as I didn't want to spend any extra time there. I then filled up miserably on the way home as I was wrongly accused of theft. What thief would take especially discounted items and still for such a small total amount and scan them all and in front of the security guard? What's more, I scanned my Cumulus card so that I could be clearly identified! I read afterwards that theft must always be intentional and that there is no such thing as negligent theft - if I had known that, I would never have signed this report. Now I'm waiting for the fine, which I'm going to appeal against because it's unjust. I will also be contacting Migros for an apology, as criminalization in situations like this simply shouldn't happen. It is also the very first time that something like this has happened to me and I have read that fines are normally only issued in the event of a repeat offense. You can't be accused of theft just because you were distracted for a few seconds. I also paid the bill immediately when I was asked to do so and the whole procedure afterwards was unnecessary. Migros has certainly lost me as a customer today - it's not about the fine, but about the treatment as if I were a criminal...
